De Lus brickt rechtszaak tegen Stars, Duthie tekent bij Party

Marcel Lüske heeft in Nevada een rechtszaak verloren tegen PokerStars over het gebruik van de FIDPA toernooiregels. PokerStars stelde eigen regels samen, die volgens Lüske een kopie waren van de zijne. En EPT-oprichter John Duthie is de nieuwe toernooibaas bij partypoker LIVE.

Een tegenvaller voor Marcel Lüske. Nederlands meest succesvolle live pokerpro (gekeken naar het totaal aan cashes) verloor de rechtszaak tegen zijn voormalig werkgever PokerStars over het gebruik van zijn FIDPA toernooiregels. Lüske liet het copyright op deze regels registreren in 2008. Volgens Lüske vertelde PokerStars hem dat ze de pokerregels wilden gebruiken en dat ze een vergoeding van $25.000 per jaar overeen kwamen. Die deal belandde echter niet op papier en PokerStars maakte haar eigen regels, te weten de PSLive Rules.

Clark County District Judge Nancy Allf gaf PokerStars gelijk. De Lus heeft tot 7 maart de tijd om in beroep te gaan. Dan zal hij wel met aanvullende documenten op de proppen moeten komen zoals een overeenkomst met PokerStars. “Luske also must specify whether the poker rules were copyrighted andfor how long, the terms of contracts, and whether there wereperformance and consideration to address deficiencies with his ongoingor prospective economic reliance claim.”

PokerStars verdedigde zichzelf door te wijzen op het gebrek aan bewijs en kreeg daarin gelijk. “PokerStars claims Luske did not state material terms of a contract forhis poker rules, is time-barred from claiming interference with aprospective economic advantage because he declined an offer for hispoker rules in 2013, and has not shown any basis for fraud.”

Duthie het of Duthie het niet!
Hij Duth het! partypoker kondigde eerder al een nieuwe live pokertour aan en heeft nu John Duthie binnengehaald als grote baas van die tour. In zijn nieuwe functie bij partypoker is Duthie de voorzitter van partypoker LIVE, de nieuwe globale pokertour van de pokerroom. Wat bij die tour vooral opvalt zijn de massieve gegarandeerde prijzenpotten.
